It has been estimated that between 60 and 80 percent of the United States population are using psychoactive substances either at work or at home. Most use alcohol, but a substantial number use illicit drugs such as marijuana, cocaine or heroin. To select the best method for controlling drugs and alcohol at work, you must ascertain the risks and the attendant costs.
In investigating drug and alcohol abuse, you must weigh the liabilities of your actions. The high cost of abuse can be quickly overtaken by the high cost of claims for: (1) invasion of privacy, (2) defamation, (3) false arrest, (4) false imprisonment, (5) outrageous conduct, (6) intentional infliction of emotional distress, (7) discrimination, (8) unfair labor practice and (9) unjust dismissal.
